EEA vs Non-EEA Ownership (Act 19/1966)
RestrictiveREAD THIS FIRST: foreign-ownership rights differ by nationality under the Act on the Right of Ownership and Use of Real Property No. 19/1966. EEA / EFTA citizens (and their businesses) can buy largely freely, on par with Icelandic nationals. NON-EEA nationals generally need an exemption / permission from the Ministry of Justice before acquiring real property.
- EEA / EFTA citizens buy freely (including for residence, business or holiday use)
- Non-EEA nationals must obtain Ministry of Justice permission, typically requiring a legitimate connection (legal residency, business use, or family ties)
- Exemption conditions are strict: the property may not exceed 3.5 hectares, the applicant may not already own other property in Iceland, and permission is property-specific
- Separate restrictions apply to large land / farmland holdings
- Ministry decisions commonly take weeks to a few months
